In Germany and the European Union, the fundamental right of freedom of opinion is recognized and protected; the constitutional provision for the regulation of freedom of opinion is outlined in Article 5 of the Basic Law; the Federal Constitutional Court, being the highest court in Germany, has rendered several decisions pertaining to the issue of freedom of expression;

It is hereby stated that:

Article 5(1) of the Basic Law guarantees the right of every individual to freely express and disseminate their opinions through speech, writing, pictures, and access information from publicly accessible sources. Furthermore, it ensures the freedom of the press and freedom of reporting through radio and film, explicitly prohibiting any form of censorship.

The scope of protection provided by Article 5(1) sentence 1 of the Basic Law encompasses opinions, which are defined as statements characterized by an expression of personal judgment. This protection is irrespective of the opinions' veracity, justifiability, emotional or rational nature, perceived value, or potential for harm. Additionally, factual communications are also covered by the protection of Article 5(1) sentence 1, to the extent that they contribute to the formation of opinions.

The Charter of Fundamental Rights of the European Union, specifically Article 11, also guarantees the freedom of opinion.
